Agreeing to these terms

By using www.erbamarkets.com you accept these terms. If you do not accept them, please do not use the site. "We", "us" and "our" mean ERBA Markets; "you" means you.

You must be 21

Cannabis is sold in California only to adults 21 and over, or to patients 18 and over holding a valid physician's recommendation. We ask you to confirm your age before showing a menu, and we check valid, non-expired, government issued photo identification in the store and at the door on every delivery. No ID, no sale, and the order goes back to the room.

Buying cannabis for anyone under 21 is a crime in California, and we will refuse any order we believe is being placed for a minor.

Our licences

We are licensed by the California Department of Cannabis Control. ERBA Sawtelle operates under licence C10-0000626-LIC and ERBA West LA under licence C10-0000383-LIC. Cannabis remains illegal under United States federal law; nothing we sell may be transported across a state line.

Orders, prices and availability

• An order placed on this site is an offer to buy. It is accepted when we confirm it, and we may decline any order.
• The price shown already includes the day's discount. California cannabis excise tax and applicable sales taxes are added at checkout and shown before you confirm.
• Prices, discounts and specials change without notice, and every deal runs while supplies last.
• Menu stock reflects what is in the room at the time of loading. If something sells out between your order and our packing it, we will call you before substituting anything.
• Potency figures come from the certificate of analysis for the batch physically on the shelf, and they change from batch to batch. They are the tested result, not a guarantee of effect.
• We may correct an obvious pricing error and cancel an affected order, refunding anything already paid.

Delivery and pickup

• Delivery is free on orders over $30 within our service area, with no service charge added.
• We deliver during the hours published for each room, and only to a physical address within our area. We cannot deliver to a school, a federal building, or a public place.
• Delivery times are estimates. Traffic in Los Angeles is what it is.
• An order placed outside delivery hours is held and goes out when delivery next opens.
• The person receiving the order must be 21 or over and present the same identification and, where a card was used, the card itself.
• If nobody is there, or the ID does not check out, the order returns to the room and we will call you.

Payment

We take cash, debit and credit. Debit requires a four digit PIN and carries a $3 bank processing fee, which is charged by the bank and not by us. Card numbers are handled by our payment processor and are never stored on this website.

Returns

All sales are final, as California regulations require of licensed retailers. If a product is defective, contact the room you bought it from on the same day and we will make it right within what the regulations allow.

Gift cards

Digital gift cards are issued by Birchmount and are redeemable at both rooms in store, on curbside pickup and on delivery. They carry no fees and do not expire. A gift card does not exempt anyone from the age check. Purchasing one is subject to Birchmount's terms as well as these.

Your account

You are responsible for what happens under your account and for keeping your password to yourself. Tell us straight away if you think someone else has it. We may suspend an account we believe is being used fraudulently or to obtain cannabis for a minor.

Using this site

The text, photography, layout and code on this site belong to ERBA Markets or to our licensors. You are welcome to read it, print it and link to it. You may not republish it, sell it, or scrape it at volume. Brand names and logos belong to the brands themselves.

Health

Nothing on this site is medical advice. Cannabis affects people differently and can impair coordination and judgement. Do not drive or operate machinery after using it. If you are pregnant or breastfeeding, or taking prescription medication, talk to a doctor first. Keep everything you buy out of reach of children and animals.

Proposition 65 warning. This product can expose you to chemicals including marijuana smoke, which is known to the State of California to cause cancer and reproductive harm. For more information go to www.P65Warnings.ca.gov.

Availability and liability

We try to keep this site up and accurate, but we do not promise it will always be available or free of error. To the fullest extent California law allows, we are not liable for indirect or consequential loss arising from using it. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Pages here link to services we do not run - Matterport, Birchmount, Google Maps - and we are not responsible for their content or their practices.

Changes and governing law

We may update these terms; the current version is always the one on this page and the date at the top says when it changed. These terms are governed by the laws of the State of California, and the courts of Los Angeles County have jurisdiction.
